The plaintiff hired the defendant to babysit her pet hamster. The defendant lost the hamster and she’s distraught, so she’s suing for emotional distress. The defendant argues he runs a pet shop and has never had a pet escape before this. He claims the plaintiff gave him a faulty cage for the animal, so it’s not his fault. He gave her a new hamster and he doesn’t think he owes her for emotional distress.
