What is Early Neutral Evaluation
Early neutral evaluation is a form of alternative dispute resolution which is not binding on the parties. In an early neutral evaluation, the impartial, who is likely to be a judge or a retired judge, hear each party's submissions and then states his view on the possible outcome at trial. That opinion is without prejudice and has no binding effect. When the parties proceed with litigation, this process is more likely to be used ad hoc, at least until there is more understanding of it in use.
