What is Facilitative ADR?
Alternative Dispute Resolution, known as ADR, is a set of processes and procedures involving an impartial third party that helps parties to a conflict to resolve their dispute without initiating formal legal action. The overarching purpose of ADR is to allow parties to settle their disputes as fast, efficiently and amicably as possible. There are three types of alternative dispute resolution. Facilitative, advisory and determinative. Facilitative ADR is a set of procedures in which an independent third person assists parties in recognising issues in a dispute. They further assist the parties in developing options to overcome them, evaluating the alternatives and hopefully reaching a mutually acceptable agreement. Such as mediation, conciliation, facilitation, or facilitated negotiation processes. Mediation is the fastest growing ADR process globally.
